Rob From the Rich, the Poor and Everyone In
Between.
We’d like to welcome you to this month’s issue
of the Lawyers Stink E-mail Newsletter. We hope all is going well and
you’re enjoying a lawyer free day, although the prospects for doing so has
become an almost impossible task these days.
The reason I say it’s almost impossible to avoid lawyers is … well,
because it is. While there are some of us lucky enough to not have to deal
directly with lawyers on a daily basis, that doesn’t mean we are not
financially affected by lawyers in an indirect but very expensive manner
every single day – because we are. That’s right, regardless of whether
we’ve been sued or not, not a day goes by that lawyers don’t manage to get
their greedy hands into our pockets.
Surprisingly, a number of people in America have no idea how serious a
problem frivolous litigation is and how much it costs them annually.
Millions haven’t yet caught wind of the biggest heist in the history of
this country, even though it’s going on right under their noses. Hard
working folks all across America are being victimized by a merry band of
robbing hoods. These hoods, unlike the legendary Robin Hood of yesteryear,
don’t just rob from the rich. No, these hoods don’t pick favorites; they
will indiscriminately rob from the rich, the poor and everyone in between.
Then after they’ve made off with all of the loot, they don’t give it to
the poor; although they will try to con us into thinking they do. While
they may toss the lowly masses an occasional bone to chew on, these
robbing hoods keep most of the bundle for themselves. Who are these
dastardly robbing hoods, as if you need to ask? America’s lawyers, that’s
who.
Contrary to popular belief, every single person in America pays a heavy
price for all of the frivolous litigation that is being hurled at every
imaginable target these days. It is estimated that frivolous litigation
costs each man, woman and child over $1,200 per year – and that’s per
person. That’s almost five thousand dollars for a family of four – rich
and poor alike!
It sometimes seems as if litigation has replaced baseball as America’s
favorite past time. Sadly many Americans have jumped on the lawsuit
express, looking to strike it rich by suing those who have allegedly
mistreated them in one form or fashion. Americans now regularly sue one
another like it’s going out of style, which it unfortunately isn’t. As a
result, many of America’s businesses find themselves relentlessly hammered
with a multitude of lawsuits.
These businesses, when served with a frivolous lawsuit that has no real
basis in fact, can choose to either 1) hire an attorney and fight the
lawsuit in court (which can be a very expensive proposition) or 2) pony up
some money to settle the lawsuit (which can be very expensive as well). In
either event, the business will have to fork over some serious coin to get
the lawsuit and the lawyers out of its hair. Where do you suppose the
money to pay these ongoing legal costs comes from? At first blush, the
answer seems obvious. The money will come from the company’s bank account.
Fair enough, but where does the company get its money from? From selling
its goods and/or services to its customers. Buckle your seat belts,
because here comes the rest of the robbing hood scary tale.
Any viable business enterprise, especially in light of the runaway civil
litigation environment that’s become quite the rage these days, has no
choice but to pass any litigation costs incurred on down the line to its
customers. While we as consumers and customers might not like having to
eat these added costs, which are reflected in the increased prices of the
goods and services we purchase, that’s just the way it is. Like it or not,
all companies must compensate for the losses incurred fighting lawyers and
lawsuits if they’re going to stay in business.
Most Americans have failed to recognize that virtually everything they
purchase or consume these days comes with a litigation “tax” attached.
This “tax’ is the increased cost that can be directly attributed to
excessive, frivolous litigation. The clothes we wear, the food we eat and
the gas we put into our vehicles all have an added litigation tax
attached.
The insurance we pay, the taxes we pay (yes, government gets sued and
government must recoup the legal costs through a heavier tax burden on its
taxpayers), the cost of health care and the costs of the cars we buy comes
with a litigation tax attached. In fact, you’ll be hard pressed to come up
with even one product or service in America that isn’t impacted by
frivolous litigation and as a result, doesn’t come with an increased price
tag as a result. Good luck in finding one.
Lawyers, ever the masters of misdirection, will get up on their high horse
and beat their chests and proclaim to any and all that they protect the
little guys of the country from the mean, nasty, villainous Corporate
America types. They will hoot and holler about how they represent the
underdog and are champions of poorer Americans everywhere. How in the
world can they possibly keep a straight face when they’re dishing out this
swill?
Come on, for crying out loud, it is their abuse of the legal system that
directly or indirectly takes a huge chunk of change out of the pockets of
America’s poorest families. Think about it for a minute. When the costs of
groceries, clothing, housing, medicine, insurance and the like goes up due
to costs associated with excessive and unwarranted litigation, who ends up
getting hurt the most? The poorer Americans, of course.
These poorer Americans are the very people that the blowhard lawyers will
squawk about helping. It is our mission to educate every American about
how frivolous litigation hurts all of us – not some of us. This is
especially true for the poorest of our population. The lawyers, not
surprisingly, will spin a different story about helping the underdog and
underprivileged. Helping the little guy, my ass. The facts speak for
themselves and besides, when have lawyers been known for their honesty
anyway?
We have to come to grips with the stark reality of the situation. Lawsuit
abuse financially impacts every person living in this country. This out of
order and out of control system translates into higher taxes, higher
insurance premiums, increased costs for goods and services and increased
health care costs for all of us. Not for some of us, but each and every
one of us.
Correcting the problem and eliminating these rampant abuses of the legal
system will require restoration of some fairness, common sense and
personal responsibility back into the system – things that many aberrant
members of the legal community have worked overtime to tear apart. This is
a daunting challenge. We should expect the lawyers, the supposed champions
of the little guy, to fight us every step of the way. After all, they like
things just the way they are (rob from the rich, poor and in between … and
keep it all for themselves).

our side and are diligently working to stop lawsuit abuse in America (you

contact them, since they could sure use your support.
No doubt about it, it will take a massive grass roots effort to take
America back from the lawyers who are intent on siphoning every dollar
from every Americans’ wallet. But please remember we have one thing going
for us that the lawyers simply do not have – and that’s a commitment to do
what’s right for our country and its hard working citizenry. By working
together, we can make a difference.
