Today we’re going to talk about an age old term used in the legal
profession -- law and order – and how that axiom has become passé. When
you stop and take a good, hard look at how our legal system operates these
days, you’ll quickly notice that law and order just don’t have a lot in
common in America’s courtrooms anymore. When a judge smacks the gavel on
his or her desk and demands order in the court, order is the one thing we
should expect – and it’s about the last thing we actually get. And that’s
not a good sign for any of us outside the sanctified bounds of the legal
profession.
If there is one thing that’s definitely missing in America’s legal system
today, it is any semblance of order. We’ve got lawyers suing anybody and
everybody in sight. We live in a litigation charged environment where not
one of us is safe from the radar screens of opportunistic lawyers gunning
for trouble. We have judges heartily accepting campaign contributions from
lawyers; the very lawyers who routinely bring cases before the very same
judges. We have a legal system where good old boy networks and back room
deal cutting are “just business as usual”. We have a legal system where
you don’t have to be wrong to be sued and you don’t have to be right to
win.
Personal responsibility, once the cornerstone of a proud country, is being
shunned like the plague as all of us have become victims and targets – all
at the same time. Lawsuits are being filed at a mind numbing clip (at the
rate of one every two seconds presently) and American consumers are being
forced to pick up the ever increasing tab. We have lawyers collecting
millions and even billions of dollars in fees while their hapless clients
are summarily tossed a bone or floated a token coupon.
Whenever outside concerns attempt to upset the apple cart and make any
kind of effort aimed at cleaning up or reforming the blight that is the
legal system today, these well intentioned groups are haughtily rebuffed
by the power and political clout of the legal community and summarily
kicked to the curb. The message is clear: nobody better mess with the
lawyers!
Government bureaucracies are replete with scads of self serving lawyers;
power crazed megalomaniacs either holding political seats or alternatively
holding positions of tremendous influence. Lawyers as lawmakers make the
laws. Lawyers as judges interpret the laws. Lawyers as District Attorneys
or Attorneys General prosecute the laws. We now find ourselves saddled
with a government of the lawyers, by the lawyers and for the lawyers. With
the only ones policing lawyers being the lawyers themselves, the nebulous
concept of lawyer discipline is nothing short of an outright joke.
Frivolous lawsuits choke our already overloaded and overburdened legal
system. Acts of deception, distortion, lying, cheating and outright fraud
by lawyers everywhere are now casually overlooked; merely viewed as some
of the tricks of the lawyers’ trade. The cost of legal representation has
continued to soar right through the roof. And if you can actually afford
to take a case to court, you can expect the lawsuit to drag on for years
and years. Sometimes justice is about the last thing you receive from
America’s justice system. Can anyone honestly, with the notable exception
of the legal community itself (and what has honesty and lawyers have to do
with each other anyway?), really call this unseemly mess law and order
anymore? Hardly.
This mess desperately needs to be cleaned up. it’s painfully obvious that
we need to restore some order to the law. Still not totally convinced of
the magnitude of this nationwide problem? Then take a look at these
numbers and try not to choke. Regardless of whether we have been sued or
not, we each pay over $1,000 annually to subsidize the frivolous lawsuits
that are cropping up at a frightening rate. The costs associated with
lawsuit abuse ultimately ends up smack dab in the laps of each man, woman
and child living in America. This is money that is siphoned from the
wallets of hard working families and then is redirected into the already
bulging bank accounts of fat cat lawyers nationwide. This routine obscene
abuse of America’s legal system by money grubbing lawyers results in the
largest transfer of wealth in this country’s history: from some of the
poorest families in our country into the coffers of some of the richest
trial lawyers in America.
We have to come to grips with the stark reality of the situation. Lawsuit
abuse financially impacts every person living in this country. This out of
order and out of control system translates into higher taxes, higher
insurance premiums, increased costs for goods and services and increased
health care costs for all of us. Not for some of us, but each and every
one of us.
Correcting the problem and eliminating these rampant abuses of the legal
system will require little more than restoration of some fairness, common
sense and personal responsibility back into the system – things that many
aberrant members of the legal community have worked overtime to tear
apart. We should expect the lawyers, the supposed champions of the little
guy, to fight us every step of the way. After all, they like things just
the way they are (rob from the rich, poor and in between … and keep it all
for themselves). They are not about to give up this gravy train without
pulling out all the stops. Fortunately, there are many organizations
around the country who are on our side and are diligently working to stop
lawsuit abuse in America (you can check them out at our

links page). We urge you to contact them, since they could sure use your
support.
Taking America back from the lawyers will require a massive grass roots
effort. After all, they have money, power and position on their side.
However, we have one thing going for us that the lawyers simply do not
have – and that’s a commitment to do what’s right for our country and its
hard working citizenry. Please remember that by working together, we can
make a difference.
