What You Don’t Know Can Hurt You.
We’d like to welcome you to this month’s issue
of the Lawyers Stink E-mail Newsletter. As is always the case here at
Power-of-Attorneys.com, it is our sincerest wish that you are doing well
and are avoiding attorneys like the plague that they are. Today’s topic is
“what you don’t know can hurt you”. Let’s get started and see what I’m
talking about here.
As I speak to people around the country about rampant lawsuit abuse and
its disruptive influence on all of our lives, I am on occasion confronted
with a skeptical sort who believes that I’m grossly overstating the
lawsuit abuse problem. These cynics are quick to tell me how they fail to
see what the big fuss is all about and as a result, fail to understand why
in the world I’m wasting my time talking about what they perceive as a
nonexistent problem.
I always welcome the opportunity to help these unenlightened folks open
their eyes to the widespread abuse of our legal system and see why it is
imperative that we start fixing this ever growing problem before it is too
late. Runaway civil litigation profoundly affects each and every person
living in this country. Regardless of whether or not you have been sued,
the innumerable frivolous lawsuits filed nationwide every day costs all of
us right where it hurts the most – right in the wallet. If you have ever
felt the brunt of a lawsuit directly in your life, I certainly don’t have
to explain how much the lawsuit costs you both from an emotional and
financial perspective – win, lose or draw.
Usually the doubting Thomas types are those who have never been sued and
as a result foolishly con themselves into believing that lawyers and
lawsuits don’t really affect them at all. Unfortunately, nothing could be
further from the truth. Still not quite convinced yourself? Fair enough,
let’s take a closer look and see if we can open your eyes as well.
The lawsuit mania that has swept across our country like an uncontrolled
wild fire, where a sue or be sued mentality has grown to epidemic
proportions among our citizenry, has pronounced direct and indirect
influences on each of us. Virtually every facet of our culture has been
touched and ultimately tainted in some form or fashion by lawyers and
lawsuits. Pick an industry and you can bet your bottom dollar (if you have
any left after the lawyers finish picking your bones clean) it has been
hammered by any of a number of shakedown specialists (a.k.a.: bloodsucking
lawyers). None of us are exempt – and all of us pay and pay big time.
Let’s take the health care industry for example. Although you may not be a
doctor or health care professional and you may have never been sued in
your life, lawyers still manage to get into your pockets. By the way,
don’t feel too left out in the cold just because you haven’t been sued
yet. No need to worry, your number will get pulled sooner or later
(probably much sooner than you think). Anyway, all of those hundreds of
thousands of frivolous lawsuits levied against the health care industry
every year has a direct and indirect impact on you. Yes, you!
The flood of medical malpractice lawsuits has exacted a heavy toll on the
health care industry. In many areas, doctors are either pulling up stakes
and moving to less litigious areas of the country (not to be confused with
non-litigious areas which would be fantasy land) or in some instances,
simply retiring. These mass exoduses are a direct result of the onslaught
of medical malpractice lawsuits that hammer the heck out of doctors and
hospitals alike. This leaves the citizens of these communities scrambling
to locate medical treatment, sometimes requiring the patients to drive
dozens and even hundreds of miles to find a doctor.
Even if the geographical area has an ample supply of medical treatment
facilities and physicians, the costs associated with litigation against
the health care industry increases the cost of health care in that area.
After all, the increased costs of malpractice insurance premiums paid by
the doctors must reflected in the increased cost of medical care.
In a nutshell, this cost of doing business must be passed on down the line
and that means you and me pay more for medical care, medical insurance
premiums, prescriptions and the like. So even though we were not the ones
getting sued, we still are forced to pay these increased costs for health
care services. Sadly, we indirectly pad the pockets of the lawyers who
file questionable if not outright fraudulent lawsuits against health care
providers each time we go to the doctor’s office.
Don’t think, even for a moment, that increased costs associated with
frivolous litigation is isolated only to the health care profession. Far
from it. The automobile, insurance, grocery, banking, energy, oil and
clothing industries (I could keep going since the list is virtually
endless) along with local, state and federal governments are forced to set
aside a goodly portion of their budgets to combat nonstop litigation
hurled their direction from lawyers looking to make a quick score.
Naturally, having to constantly defend themselves against lawsuits results
in increased costs of goods and services.
As far as the businesses are concerned, the increased costs attributed to
frivolous litigation must be recouped through a higher pricing structure
to its customers. In the case of government, reckless lawsuit abuse
results in substantially higher taxes being paid by the taxpayers. Hey,
you’re both a customer and a taxpayer as well. Want to take a stab at what
that means.
That’s right, indirectly you pay lawyers each and every time you pay your
utility bill, pump gas into your vehicle and purchase a bag of groceries.
You indirectly pay lawyers every time you buy a car, pick up clothes at
the dry cleaners or eat dinner at a restaurant. You indirectly pay lawyers
every time you go to the theater, purchase an airline ticket or buy a pair
of shoes. I could go on and on, but hopefully you’re starting to get the

Lawsuit abuse touches the lives of every person living in our great
country. If we continue to allow renegade lawyers to run rampant and
unchecked as they sling hundreds of thousands of fraudulent lawsuits
against every target imaginable month after month, then these lawyers will
continue to seize more and more of our hard earned dollars, regardless of
whether we have been actually sued or not. One way or the other, these
avaricious lawyers want every dollar they can get their hands on –
including yours (whether you think so or not). If we don’t stop them,
they’re going to keep bringing the heavy heat until they have successfully
siphoned every remaining dollar from every American.
Believe me when I tell you once more, what you don’t know (and what other
Americans don’t know as well) can definitely hurt us all. You’d better
wake up and smell the lawyers at work.
